Statutory Regulatory Framework

How UK Car Tax (Vehicle Excise Duty) Works

In the United Kingdom, road tax is officially designated as Vehicle Excise Duty (VED). Enacted and governed under the Vehicle Excise and Registration Act 1994 (VERA 1994), VED is an excise tax levied on every motor vehicle registered to drive or park on UK public roads. Vehicle taxation is administered and enforced directly by the Driver and Vehicle Licensing Agency (DVLA) on behalf of HM Treasury.

The method used to calculate your road tax depends strictly on the exact date your vehicle was first registered. The UK operates three distinct statutory VED regimes:

Regime 1: Current
Post-1 April 2017

Showroom first-year tax based on CO2, followed by a standard flat rate (£190/yr) plus £410 expensive car supplement for vehicles exceeding £40,000.

Regime 2: Graduated
2001 to 2017

Vehicles are taxed purely on official tailpipe CO2 emissions across 13 statutory tiers (Bands A through M), ranging from £0 to £710/yr.

Regime 3: Classic / Historic
Before 1 March 2001

Private and Light Goods (PLG) vehicles taxed strictly by engine cylinder displacement (not exceeding 1,549 cc vs over 1,549 cc).

Modern Vehicle Taxation

The Post-2017 System: First-Year Showroom Tax & Standard Renewal Rates

For passenger cars registered on or after 1 April 2017, road tax is split into two separate phases: the first-year rate and the standard renewal rate.

Phase 1: First-Year Showroom Rate (Brand New Cars)

When a brand new car is registered for the very first time, the first 12 months of road tax are calculated strictly on its certified tailpipe CO2 emissions (g/km) under the Worldwide Harmonised Light Vehicle Test Procedure (WLTP). This showroom tax is typically built directly into the car dealer's "On-The-Road" (OTR) purchase price.

Over 255 g/km£2,745£2,735N/A

Phase 2: Standard Annual Flat Rate (Year 2 Onwards)

From the vehicle's second year onwards, the CO2-graduated scale is completely discarded. All standard vehicles pay a single statutory flat annual rate:

  • Petrol and Diesel: £190 per year (£199.50 if paid via monthly Direct Debit).
  • Alternative Fuel (Hybrids & LPG): £180 per year (£10 statutory discount).
  • Electric Vehicles (EVs): £190 per year (statutorily equalised under recent Finance Act measures).
Luxury Vehicle Surcharge

The £40,000 Expensive Car Supplement (Years 2 to 6)

Under Schedule 1, Part 1AA of VERA 1994, vehicles with an original manufacturer list price exceeding £40,000 are subject to an additional £410 per year expensive car supplement. This supplement runs for exactly 5 consecutive years, starting on the second tax disc renewal (Years 2 through 6).

Critical Pitfall: How the £40,000 List Price Is Defined

The £40,000 threshold is based strictly on the published manufacturer list price on the day before the vehicle was first registered. It encompasses the basic vehicle price, 20% VAT, standard delivery charges, and all factory-fitted optional extras (such as upgraded alloy wheels, panoramic sunroofs, leather interiors, and driver assistance packages).

Crucially, dealer discounts, manufacturer deposit contributions, and trade-in allowances are completely ignored by the DVLA. If a car has a list price of £41,200 but you negotiated a discounted invoice price of £38,000, you are still legally liable for the £410 annual supplement for 5 years!

Hybrid > £40k

Electric (EV) > £40k

Expiration Rule: Once the vehicle reaches 6 years of age, the £410 supplement automatically expires. For Year 7 and all subsequent years, your road tax reverts to the standard annual flat rate of £190 (or £180 for hybrids).

Historic Graduated Tiers

Pre-2017 Cars: Graduated CO2 Bands A to M (2001 to 2017)

If your car was registered between 1 March 2001 and 31 March 2017, your road tax remains permanently pegged to its official NEDC CO2 emissions figure listed on Section V.7 of your V5C registration document. Unlike post-2017 cars, there is no expensive car supplement regardless of the vehicle's original price tag.

Zero-Emission Legislation

Electric Vehicles (EV) Road Tax: The Statutory Equalisation

Historically, pure electric vehicles were completely exempt from Vehicle Excise Duty (paying £0 under Band A). However, under statutory amendments equalising road transport contributions across all propulsion types, electric cars are now integrated into the standard VED framework:

First Year Showroom Tax: Brand new electric vehicles pay a nominal first-year showroom tax of £10.
Year 2 Onwards Flat Rate: From the second year, electric vehicles pay the standard flat rate of £190 per year.
£40,000 Expensive Car Surcharge: Zero-emission electric vehicles with an original list price exceeding £40,000 registered on or after 1 April 2025 are subject to the £410 per year expensive car supplement for 5 years, bringing total annual road tax to £600 per year.
DVLA Payment Rules

DVLA Payment Options & Statutory 5% Surcharges

When taxing your vehicle online through the DVLA portal, by telephone, or at a Post Office branch, you have three primary payment frequencies:

12 Months (Single Upfront)

Paid via debit card, credit card, or annual Direct Debit. This is the most economical statutory option, incurring 0% surcharge.

12 Months (Monthly Direct Debit)

Direct Debit payments split over 12 equal monthly instalments incur a statutory 5% surcharge. On £190, you pay £16.63/mo (£199.50/yr).

6 Months (Single Payment)

Available for vehicles with annual tax above £50. Charged at 52.5% of the annual rate (half-year fee plus 5% surcharge), e.g., £99.75 on £190.

Car Tax Frequently Asked Questions (2026/27)

Statutory answers regarding road tax bands, the £40,000 supplement, EV rules, and DVLA refunds.

For passenger cars registered on or after 1 April 2017, the standard annual road tax (Vehicle Excise Duty) from Year 2 onwards is £190 per year for petrol and diesel vehicles, and £180 per year for alternative fuel vehicles (hybrids). If the vehicle's original manufacturer list price exceeded £40,000 when new, an additional £410 per year expensive car supplement applies for 5 years (Years 2 to 6), making the total £600 per year (£590 for hybrids). Cars registered between 1 March 2001 and 31 March 2017 are taxed based on their CO2 emission bands (Bands A to M), ranging from £0 to £710 per year.

Vehicle tax is not company-car tax

Use the vehicle registration date, fuel type, emissions and list-price rules for the actual vehicle. VED and a company-car benefit-in-kind charge are separate taxes.

Registration details, first-year rates, expensive-car supplements and exemptions can change the amount. Confirm the DVLA record before purchasing tax or relying on a refund estimate.
