1. How the UK Cycle to Work Scheme Operates
The UK Cycle to Work initiative is governed by Section 244 of the Income Tax (Earnings and Pensions) Act 2003 (ITEPA 2003). Under this legislation, no liability to Income Tax or National Insurance contributions arises when an employer provides an employee with a bicycle and cycling safety accessories, provided that:
- The bicycle and equipment are used mainly (at least 50% of qualifying journeys) for commuting between home and a permanent workplace, or travel between workplaces.
- The scheme is made available generally to all eligible employees across the business without discriminatory selection.
- The bicycle remains owned by the employer or an approved third-party scheme provider throughout the initial contractual hire term.
Because payments are structured via salary sacrifice under Section 69B ITEPA 2003, the employee contractual gross salary is reduced before PAYE tax and Class 1 employee National Insurance (8% on earnings between £12,570 and £50,270, and 2% above £50,270) are calculated.
2. Real Savings by UK Marginal Tax Band
The percentage saved on your bicycle package is directly determined by your top marginal tax band. Higher earners generate larger absolute savings because their marginal tax relief is greater:
| Marginal Band | Income Tax Relief | Class 1 NI Relief | Total Employee Saving | Net Cost on £1,500 Bike |
|---|---|---|---|---|
| Basic Rate (£12,571–£50,270) | 20.0% | 8.0% | 28.0% | £1,080 (£90.00/mo) |
| Higher Rate (£50,271–£125,140) | 40.0% | 2.0% | 42.0% | £870 (£72.50/mo) |
| £100k–£125,140 Taper Trap | 60.0% (PA Taper) | 2.0% | 62.0% | £570 (£47.50/mo) |
| Additional Rate (£125,140+) | 45.0% | 2.0% | 47.0% | £795 (£66.25/mo) |
3. NMW Safeguards and Fair Market Valuation
Two critical legal provisions govern all Cycle to Work packages across the UK:
National Living Wage Protection
Under Regulation 13 of the National Minimum Wage Regulations 2015, salary sacrifice cannot reduce an employee cash wage below the statutory minimum (£12.71/hr for 21+). Employers must reject or spread deductions over longer terms (e.g. 24 or 36 months) if a shorter hire term breaches NMW.
HMRC End of Hire Valuation
To avoid creating a taxable Benefit-in-Kind, the bike cannot be gifted free of charge at the end of year 1. Employees sign an Extended Use agreement paying a small 3% to 7% deposit. By year 4 or 5, HMRC fair market value drops to zero, and title transfers at zero extra cost.
